3M™ 2008 Performance Driven NASCAR® Promotion
Instant Win Game Official Rules

The following Game is intended for play and participation in the United States only and shall only be construed and evaluated according to the laws of the United States. Please do not enter this Game unless you are a legal resident of the 50 United States or the District of Columbia and located in the United States at the time of entry.

Promotion begins 12:00:01 a.m. Central Time (“CT”) on March 1, 2008 and ends at 11:59:59 p.m. CT on February 28, 2009 ("Promotion Period").

1. Eligibility: NO PURCHASE NECESSARY TO ENTER. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING. Game is open only to legal residents of the 50 United States and the District of Columbia age 18 or older (19 in AL and NE). Void in Puerto Rico and where prohibited or restricted by law. Employees, directors, officers and agents of 3M and NASCAR, Inc.; their subsidiary companies, sales representatives, advertising and promotion agencies, and members of their immediate families (parent, child, sibling and spouse of each) or households of any of the above are prohibited from playing the Game.

2. How to Play: Look for the promotional code on any promotional package of Scotch-Blue™ Painter's Tape, 3M™ Hand-Masker™ Products, Scotch® Duct Tape or 3M™ Adhesive Products which can be purchased at any participating retailer March 1, 2008 through February 28, 2009 or until all promotional product supplies are exhausted, whichever occurs first. Go online to www.scotch-blue.com/performancedriven08 and click on the “Enter Now” game icon. Follow the instructions to submit your code and personal information as instructed in order to determine whether your play has been chosen as a potential instant winner in accordance with the random online distribution of winners throughout the Promotion Period. Limit one play per person/email address per day. All online plays must be received by 11:59:59 p.m. CT on February 28, 2009. If your code is the first code submitted on or after a randomly selected time for one of the prizes listed below, you are a potential winner of that prize, subject to verification. The results of your game play will be instantly displayed. If a prize message is shown, you are a potential prize winner, subject to verification. Plays generated by script, macro, robotic, programmed, or any other automated means are prohibited and will be disqualified. Sponsor reserves the right at its sole discretion, to disqualify any individual (and all of his or her plays) who tampers with or attempts to tamper with the game process in any way. All participants must have a valid e-mail address. Proof of transmission (screenshots or captures of game play, etc.) does not constitute proof of winning status/delivery.

3. How to Get a Code Without Purchase: To receive a free game code without purchase, go to www.scotch-blue.com/performancedriven08, click on the promotional icon for the “Enter Now” and follow the “free game code” instructions. The free game code will be generated instantly and you may then play the game as described above. Requests for codes must be received no later than 11:59:59 p.m. CT on February 28, 2009.

4. PRIZES/APPROXIMATE RETAIL VALUES (ARV)/ODDS OF WINNING. Grand Prize – One (1): Trip for two (2) to a Sponsor-specified 2009 NASCAR® sanctioned race. Prize includes round-trip coach air transportation for two, 4 days/3 nights hotel accommodations (one room, double occupancy) at Sponsor-specified hotel and suite tickets. All unspecified travel-related expenses, including but not limited to meals, transportation, gratuities and incidental hotel expenses, are the sole responsibility of the winner. Winner must be able to attend on dates specified or prize will be forfeited. ARV: $8,000.00. (Actual retail value of trip may vary and will depend on airfare fluctuations and winner's point of departure/return. Any difference between stated approximate retail value and actual value of prize will not be awarded.) All standard NASCAR® and promoter's terms and conditions apply to tickets. Winner and guest must sign NASCAR and promoter's standard release and waivers. If race is delayed, postponed or cancelled for any reason, winner will not receive cash or other substitution for tickets, but tickets may be subject to standard rain check policies and procedures established by issuer. Seat locations are at Sponsor's discretion. First Prize – Five Hundred (500): A 3M Performance Driven Hat. ARV: $7.00 each. Second Prize – Five Thousand (5,000): A 3M Duffle Bag. ARV: $6.00 each. Third Prize – Five Thousand (5,000): 3M Performance Driven T-shirt (size XL). ARV: $5.60 each. Fourth Prize – Ten Thousand (10,000): Race Day Credential Holder. ARV: $1.10 each. Total ARV of all prizes: $80,500.00. Odds of winning are based upon the number of entries and the order in which they are received. The number of prizes available to be won decreases as prizes are claimed throughout the Promotion Period. Unclaimed prizes will not be awarded.

5. Prize/Winner Verification: All prize claims are subject to verification prior to awarding of prize. Decisions of the judges are final. Winners will receive prize by mail. No transfer of prize allowed. No cash redemption or prize substitution allowed, except as provided herein. In case of unavailability of any prize, Sponsor reserves the right to substitute a prize of equal or greater value. Grand Prize winner and guest will be required to sign and return affidavits of eligibility and liability/publicity releases (where permitted) within 14 days of written notification, or prize will be forfeited. If prize notification letter or any prize is returned as undeliverable, or any prize documentation is not submitted as required by Sponsor, the corresponding prize will be forfeited. Winner may only bring a minor as a guest if guest is Winner's child or legal ward, and winner signs all required documents on behalf of minor. Should multiple users of the same e-mail account enter the Game and a dispute thereafter arise regarding the identity of the winning entrant, the authorized subscriber of said e-mail account at the time of entry will be considered the entrant. “Authorized account subscriber” is defined as the natural person who is assigned an e-mail address by an Internet access provider, on-line service provider or other organization which is responsible for assigning e-mail addresses or the domain associated with the submitted e-mail address.

6. General: All taxes on all prizes are solely the responsibility of winners. By participating in this promotion, entrants agree to abide by and be bound by these Official Rules and the decisions of the judges, which are final and binding in all matters relating to this promotion. Game codes that are not obtained through authorized, legitimate channels or that are forged, altered, blank in whole or in part, reproduced, tampered with in any way, mutilated, incomplete or that contain printing, production, typographical, mechanical, or other errors are automatically void. Liability for Game codes containing printing or other errors is limited to replacement with another Game code while supplies last. No more than the advertised number of prizes will be awarded. If prize claims at any prize level exceed the number of prizes indicated herein, such prize(s) will be awarded in a random drawing from among all valid prize claims received for that level. All submitted requests, entries and prize claims become property of 3M and will not be returned. By accepting prizes, winners consent to use of their names, photographs and/or likenesses for advertising and promotion purposes in any and all media worldwide, without limitation and without additional compensation, except where prohibited. Participants waive the right to assert as a cost of winning a prize any and all costs of redemption and any liability which might arise from redeeming or seeking to redeem said prize, or from use, misuse, acceptance or possession of said prize. By participating, entrants agree to release 3M, NASCAR, Inc., their parent companies, affiliates, subsidiaries and agents, including without limitation their advertising and promotion agencies, and each of their respective directors, employees and officers (collectively "Releasees"), from any and all liability arising from or in connection with participation in this promotion, or the awarding, receipt or use of any prize. Trip winner accepts the inherently dangerous nature and risk in attending NASCAR® sanctioned events, including personal injury and/or death, acknowledges that his/her participation in the prize event is voluntary, acknowledges that there are natural factors and occurrences which may impact on or affect the safety of the activities he/she is participating in and he/she assumes the risk of such factors and occurrences and agrees that the Released Parties shall not be in any way responsible for any resulting injury and/or death. By entering, entrants further agree that all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, participant's rights and obligations, or the rights and obligations of the Sponsor in connection with the Game, shall be governed by, and construed in accordance with the laws of State of Minnesota, without giving effect to any choice of law or conflict of law rules (whether of the State of Minnesota or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Minnesota. By entering, entrants consent to the jurisdiction and venue of the federal, state and local courts located in Minnesota. NASCAR, Inc. is not a Sponsor of this promotion. NASCAR® is a registered trademark of the National Association for Stock Car Auto Racing, Inc.

7. Limitations of Liability: Sponsor and other Releasees are not responsible for: (i) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software, delay in operation or transmission, communications line failure, technology outage, theft or destruction or unauthorized access to, or alteration of entries, whether caused by the sender or any of the equipment or programming associated with or utilized in the Game; (ii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iii) unauthorized human intervention in any part of the entry process or the Game; (iv) electronic, clerical or human error which may occur in the administration of the Game or the transmission, receipt or processing of entries or notification of winners; or (v) any injury or damage to persons or property, including but not limited to entrant's computer, hardware or software, which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Game. Without limiting the generality of the foregoing, Sponsor reserves the right, in its sole discretion, to terminate, modify, cancel or suspend this Game if fraud, technical failures including any network server or hardware failure, viruses, bugs, errors in programming, or any other errors or other causes beyond the control of Sponsor corrupt the administration, security, or proper play, of the Game. In the event of termination, remaining prizes will be awarded in a manner to be determined by Sponsor consistent with state requirements. Under no circumstances, including negligence, shall the Sponsor or the other Releasees be liable for any direct, indirect, incidental, special or consequential damages that result from the use of or inability to use the web site, or out of any breach of any warranty. This exclusion or limitation of liability will not apply to the extent that any applicable statute prohibits such exclusion or limitation of liability. WITHOUT LIMITING THE FOREGOING, EVERYTHING ON THE SPONSOR'S WEB SITE IS PROVIDED "AS IS" WITHOUT ANY WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES; CHECK YOUR LOCAL LAWS FOR ANY RESTRICTIONS REGARDING THESE LIMITATIONS OR RESTRICTIONS. Any attempt by an entrant or other individual to deliberately damage any web site or undermine the legitimate operation of this promotion, including but not limited to any fraudulent claims, may be a violation of criminal and civil laws. Should such an attempt be made, Sponsor reserves the right to seek remedies and damages from any such individual, to the fullest extent permitted by law, including criminal prosecution. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. Participant engaging in any of the foregoing activities may be disqualified and will forfeit any prizes won.

8. Winners List: For the name of the Grand Prize winner, send a self-addressed, stamped business size #10 envelope by February 28, 2009 to: 3M 2008 Performance Driven NASCAR® Promotion Winners List, P.O. Box 27175, Golden Valley, MN 55427-0175. Winners list will be sent after all winners have been verified and all claimed prizes have been awarded.
